1. Agreement to Terms

By creating an account or using 5str.io (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. These Terms apply to business owners who register for an account. End customers who visit a landing page are subject to the Privacy Policy but do not need an account.

2. Description of Service

5str.io provides tools that allow business owners to create custom customer feedback landing pages. These pages are designed to collect customer ratings and, depending on the outcome, direct customers to public review platforms or to a private feedback form. The Service also provides analytics, review solicitation tools, and related features as described on our website.

3. Eligibility

You must be at least 18 years old and capable of forming a legally binding contract to use this Service. By using 5str.io, you represent and warrant that you meet these requirements.

4. Your Account

• You are responsible for maintaining the security of your account credentials.
• You are responsible for all activity that occurs under your account.
• You must provide accurate information when creating your account and keep it up to date.
• You may not share your account with others or create accounts on behalf of third parties without their consent.

5. Your Responsibilities as a Business Owner

By using 5str.io, you agree to the following:

• Customer consent: You are solely responsible for obtaining all necessary consents from your customers before sending them any email or SMS communications via 5str.io. This includes compliance with the CAN-SPAM Act, GDPR, CCPA, and any other applicable laws. 5str.io provides the sending tool — compliance is your responsibility.
• Truthful information: You will not use the Service to mislead, deceive, or defraud customers or any third party.
• Review platform terms: You are responsible for ensuring your use of 5str.io complies with the terms of service of any third-party review platforms (Google, Yelp, etc.) you direct customers to.
• Content: You are responsible for all content you create on the platform, including landing page text, custom messages, and replies to customer feedback.
• No spam: You will not use 5str.io to send unsolicited or bulk communications.

6. Prohibited Uses

You may not use 5str.io to:

• Violate any applicable law or regulation.
• Harass, intimidate, or harm any individual.
• Collect or store personal data in violation of applicable privacy laws.
• Attempt to interfere with, compromise, or disrupt the Service or its infrastructure.
• Reverse engineer, decompile, or copy any part of the Service.
• Use the Service for any fraudulent or deceptive purpose.
• Impersonate any person or entity.

7. Subscription Plans and Billing

5str.io offers free and paid subscription tiers. Paid features are billed on a recurring monthly or annual basis through our payment processor, Stripe.

• You authorize us to charge your payment method on a recurring basis until you cancel.
• You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period — you retain access to paid features until then.
• We reserve the right to change pricing with at least 30 days' notice to active subscribers.

8. Intellectual Property

The 5str.io platform, including its design, code, and content created by us, is owned by 5str.io and protected by applicable intellectual property laws. You retain ownership of the content you create (landing page text, uploaded logos, etc.). By uploading content to 5str.io, you grant us a limited license to store and display that content solely to provide the Service to you.

9. Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms, fraudulent activity, or any other reason we deem necessary to protect the Service or its users. You may delete your account at any time from your account settings. Upon termination, your data will be deleted as described in our Privacy Policy.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, 5STR.IO AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE. IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM OR (B) $50 USD.

12. Indemnification

You agree to indemnify and hold harmless 5str.io and its operators from any claims, losses, damages, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

13. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated by updating the "Last Updated" date. Continued use of the Service after changes are posted constitutes acceptance of the updated Terms.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Washington, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Washington State, and you consent to personal jurisdiction in those courts.
